JVK LABOUR LAW AND BUSINESS PRACTITIONERS NEWSLETTER 2 OF 2024

New BC Agreement for Restaurants – What are the changes, and how will they impact employers?

Dear Employer

On 26 April 2024, the new Collective Agreement of the Bargaining Council for Restaurants, Catering, and Allied Trades (BCRAT) in Johannesburg was released.

The changes that restaurant owners can expect from 1 June 2024 are as follows:

Cleaning Allowance, Hours of Work, Transport Allowance, Bargaining Council Levy and Night Shift Allowance and Minimum Wage.

Minimum wage has increased and will be implemented from 1 June 2024.

These changes will result in the need for careful planning and implementation to ensure compliance as well as to ensure a more productive work environment.

The Standard policy audit and a policy update will be exceptionally beneficial for any restaurant owner.

In a separate memo, we will share a Labour Court judgement stating that the minimum wage as promulgated must be calculated inclusive of tips and commissions that will undoubtedly be of great benefit in normal cashflow constraints.
